Sanddune Padel Sports Club  ‘s Terms and Conditions are as follows

Online Registration age must be 18 and above otherwise, you must register in person through our reception.

Please read these terms and conditions carefully before using Our Service.

INTERPRETATIONS AND DEFINITIONS

INTERPRETATION
The words in which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

DEFINITIONS
For the purposes of this Privacy Policy:Account means a unique account created for You to access our Service or parts of our Service.Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Sanddune Sports Tracks L.L.C., referred here after as Sanddune Padel Club , Located on No. 29 - 28B Street - Al Quoz - Al Quoz Industrial Area 3 - Dubai.

Cookies are small files that are placed on Your computer, mobile device, or any other device by a website, containing the details of Your browsing history on that website among its many uses.Country refers to United Arab Emirates

Device means any device that can access the Service such as a computer, a cellphone, or a digital tablet.

Personal Data is any information that relates to an identified or identifiable individual.Service refers to the Website.

Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service, or to assist the Company in analyzing how the Service is used.Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).Website refers to Sanddune Padel Sports Club, accessible from https://www.sanddune.ae“You” means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

MEMBER’S PHYSICAL HEALTH
In accepting these Terms & Conditions the member warrants and also represents that he/she is in good health and is not knowingly incapable of engaging in either active or passive exercise. The member further warrants that such exercise would not be detrimental to their health, safety, comfort, well-being or physical condition.

The member shall not use any Sanddune Padel Sports Club’s facility whilst suffering from any infections or contagious illness, disease, or other ailments such as open cuts, abrasions, open sores, or minor infection, where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other members.

Using Sanddune Padel Sports Club’s facility, members/users fully accept all terms and conditions on this page and agree to them in full without signature.

If a member is taking medication and is aware of a condition that may affect them taking part in exercise a doctor’s letter would be needed.

If a female member is pregnant and wants to take part in any physical activity at Sanddune Padel Sports Club, it is understood that she has her doctor’s clearance to take part in activities and that she takes full responsibility for any implications associated with them.

Members or guests may not use the facilities whilst under the influence of alcohol, narcotics, or other mood-altering substances.

GENERAL TERMS
This agreement commences once you have specified your acceptance of our Terms and Conditions in the declaration section of the web sign-up process and clicked the Book now/join now button.

All new members are subject to the approval of the management. The management reserves the right to decline the application for membership to the club for any valid reason that the person has, With discretion from both parties.

Your membership will start immediately. In the case of a pre-sale membership, you shall start by the opening date of the club.

The agreement will bind us (The member and Sanddune Padel Sports Club) and you will be entitled to all the rights and privileges for your chosen membership type.  

You cannot transfer or share our agreement with anyone else. No proxy, No representative, and absolutely no substitute.

The Laws of the United Arab Emirates shall govern the Terms & Conditions, without regard to conflict of laws principles. All disputes arising in connection therewith shall be heard only by a court of competent jurisdiction in the U.A.E.

The United Arab Emirates is our Country of domicile. Sanddune Padel Sports Club controls this site from the U.A.E.

You may not use, export, or re-export any materials from this site in violation of any applicable laws or regulations, including, but not limited to any U.A.E export laws and regulations.

By visiting the Site, you represent, warrant, and covenant that (a) you are at least 18 years old; (b) The customer using the website who are Minor /under the age of 18 shall be registered by their parent or guardian, who shall transact on or use the website/app on their behalf.

Sanddune Padel Sports Club may terminate this agreement with immediate effect on notice to you if you are in breach of the club rules or these Terms and Conditions.

Soliciting and selling private personal training sessions or merchandise of any type to any member is prohibited and may result in immediate termination of the member concerned.

All members must abide by the club rules which may be amended and/or added to from time to time at the management’s discretion.

Failure by the management to enforce any of their respective rights at any time for any period shall not be construed as a waiver of such rights.

Members and/or guests are not allowed to copy any of our facilities’ interior designs, promotional materials, tag lines, themes, or concepts. We reserve the right to proceed with legal action against any member caught distributing, sharing, or supplying such content to any third-party vendor or competitor.

Use the booking system on the app to book any of our services access. You must show your booking to reception upon arrival to show that you have booked a time slot. You will be asked to wait if it is not your time slot or turned away if you have passed your time slot.

FACILITY RULES & ETIQUETTE
The use of mobile phones with camera features and/or and other types of visual records in changing rooms is strictly prohibited, and members are requested to ensure that they do not offend any other person when utilizing such equipment within our facility.

The normal hours of operation are as indicated from 7am to 12am at the facility entrance. The management reserves the right to adjust the hours for the purpose of cleaning decorating, repairs, and special private functions and holidays.

Members will not be able to join a class after it has started (management will reserve the right to extend a grace period of 5 minutes at its own discretion)

All attendees and members must register in reception.

DRESS CODE
All members are required to wear proper sports attire when exercising and to dress modestly when working out. No shirtless members will be allowed in the padel court.

Adequate footwear is required at all times on the padel court. “Crocs”, sandals and flip-flops are not considered suitable shoes. Injuries caused by wrong footwear are out of the responsibility of the club.  

Members should remain modestly and appropriately dress at all times, including in the changing areas.

Nudity is strictly not permitted and members are requested to use the private changing cubicles provided.

LOCKER ROOMS
The management accepts no responsibility for theft or damage to a member’s personal belongings kept in the lockers or otherwise for any reason whatsoever.

Temporary lockers are provided for the members who shall remove their personal belongings at the completion of their visit. The gym has the right to cut open any padlocks and remove personal belongings that are left in the lockers at the end of each day.

Unclaimed property over the value of 50 AED shall be kept by the club for a period of 1 week after which the management reserves the right to dispose of the items in such way it in their entire discretion deems fit. Clothing and other similar items will be disposed of after a 1-week period; however, any items of value will be donated. Any items below 50 AED in value will be immediately disposed of.

BEHAVIOR
Members and guests must treat Sanddune Padel Sports Club facilities and one another with respect; failure to comply shall constitute a serious breach of the terms of membership, and could result in the loss of membership.

Threatening, intimidating, or abusive behavior will not be tolerated towards any member of staff or club members. Should such incidents take place a member’s membership will be immediately suspended and all future payments will be collected immediately.

Spitting inside or outside the club premises and courts is not allowed.

We reserve the right to prevent access to, or use of, the facilities by anyone deemed to be acting inappropriately or behaving in an unacceptable manner, as determined by Sanddune Padel Sports Club Management.

As a courtesy to other members, all equipment should be returned to its correct position after use.

Sanddune Padel Sports Club operates a strict no-smoking policy. Smoking is not permitted inside the club, even all electronic smoking devices are strictly forbidden.

No ball sports, other than Padel Tennis are permitted on the padel courts.

Padel Tennis racquets to be used by players. Tennis or any other racquets are not permitted.

Jumping over, sitting or leaning on the padel court net is prohibited.

Members under 12 years of age must be accompanied by a Parent or Guardian at all times.

Any anti-social or offensive behavior will result in the member or guest being immediately evicted from the gym and their membership canceled.

Sanddune Padel Sports Club Social Media platforms are intended as a means of creating community, facilitating communications, and providing a forum for the expression of feedback. Inflammatory posts, including any content which is judged by our management at its absolute discretion to consider inappropriate, may be subject to remedial action, including removal of the offending posts, blocking access, and termination of membership as a consequence of serious misconduct.

Good personal hygiene is mandatory, and any member who causes offence will be asked to remedy the offending problem or leave the gym, and membership may be canceled at Sanddune Padel Sports Club   management’s sole discretion.

Sharing membership or packages is strictly not permitted, any member caught sharing membership cards or providing non-members with unauthorized access to Sanddune Padel Sports Club  , will be subject to their membership being canceled and the remainder of their contract period being billed.

DATA SECURITY
In the course of completing your membership and creating the Monthly Recurring Payment, we may collect certain personal information about you including personal details and information about your health and person.

We will use this information for purposes including managing your membership and communicating with you. You have the duty to keep your personal information up to date and to inform us of any significant changes.
We will limit access to the processing of and use of your personal information to our employees and management who may, from time to time, require its use for marketing or other services. In addition, from time to time, we may need to make your personal information available to third parties such as legal authorities, our group companies, and professional advisors.

Please contact us if you have any questions or concerns about how we will use and store your personal information or if you wish to exercise your right to access, modify, object to the use of, or request the deletion of your personal information.

We will endeavor to use whatever method of communication deemed appropriate to notify you of the club information in order to best serve your experience and assume that the information provided by you is correct and an acceptable method to provide you with this information.

IMAGE RELEASE
The Sanddune Padel Sports Club management reserves the right to use any individual or group photographs or videos of members and or guests for press or promotional purposes (by Sanddune Padel Sports Club or our partners) in both online, TV, and print sources, provided their inclusion is incidental and consensual.

FEES AND CHARGES
All published membership or other fees and other charges are inclusive of any taxes (i.e., VAT).The “Monthly Recurring Payment” or “Recurring Payment” means the Sanddune Padel Sports Club’s monthly membership fee corresponding to the purchased membership option (i.e., Fixed Term or Flexible), and determined by the membership type and membership term at the point of joining.

The monthly membership fee or Monthly Recurring Payment is due each month in full, upfront, in advance, and with the exception of cancellations under the terms detailed below, no partial refund of the monthly membership fee will be made unless you are canceling under cooling-off regulations detailed below.

Your second Monthly Recurring Payment will be collected one month after you joined unless you joined prior to your gym opening in which case it will be collected one month after the gym has opened. Subsequent Monthly Recurring Payments for monthly membership fees will be collected monthly thereafter.

If, despite us having notified you of a missed payment, further payments are missed, we reserve the right to, at our sole election, either suspend or terminate your membership. If ever you are over 30 days in arrears on a missed monthly payment and you are on a Fixed Term membership then we reserve the right to bill you immediately after the 30-day grace period for the remaining contract value without any prior notification.

You are obligated to make the minimum number of Monthly Recurring Payments stated in your choice of membership. You are obligated to make every Recurring Payment regardless of non-attendance, except where the cancellation terms below are met.

The date of your Monthly recurring Payment is likely to be the same date in each month as the first Monthly Recurring Payment. You are unable to amend the date of your Recurring Payment but we reserve the right to amend the date of your Monthly Recurring Payment at our sole discretion.

Once you have completed the minimum number of Monthly Recurring Payments as stated in your membership choice, we will automatically continue collecting Monthly Recurring Payments every month. Your membership will be extended by one month for each payment (“Renewal Period”).

If you have fulfilled your commitment to the membership you have joined, you may prevent the Automatic Renewal Period at any time by visiting the Sanddune Padel Sports Club’s reception and submitting a cancellation request. (A minimum of 30 days’ notice is required).

You agree to advise us immediately of any change to the Members Details provided.

You agree to retain a copy of all transaction records and you are responsible for maintaining the confidentiality of this account.

All credit/debit cards’ details and personally identifiable information will NOT be stored, sold, shared, rented, or leased to any third parties.

Sanddune Padel Sports Club takes appropriate steps to ensure data privacy and security including through various hardware and software methodologies. However, Sanddune Padel Sports Club cannot guarantee the security of any information that is disclosed online.

Sanddune Padel Sports Club is not responsible for the privacy policies of websites to which it links. If you provide any information to such third parties different rules regarding the collection and use of your personal information may apply. You should contact these entities directly if you have any questions about their use of the information that they collect.

The Website Policies and Terms & Conditions may be changed or updated occasionally to meet the requirements and standards. Therefore, the Customers are encouraged to frequently visit these sections to be updated about the changes on the website. Modifications will be effective on the day they are posted.

From time to time, we may need to amend the price of your membership. We will give members at least 1 full month’s notice of any incoming price change and will make it very clear when the price modification will take effect and what the price of your membership will be after the price change. During this period, you will have your usual right to terminate your membership in accordance with the membership terms and conditions and rules.

If you fail to pay any amount due under this agreement for a period of more than thirty days, then we may pass the debt to a third-party company for collection or take legal/police action against you. The reasonable and direct costs incurred in employing the third-party company will be borne by you including costs in tracing you if you have changed your address or contact without telling us.

PAYMENT METHODS
We accept payment by Visa or Mastercard debit and credit cards in AED for our memberships and other products and services. All online purchases are also governed by the terms and conditions of respective merchant service providers. Please review the respective merchant service provider’s user agreement and privacy policy before entering any transaction.Should any member forewarn that their membership payment method is to be canceled and not adequately replaced before the completion of a contract, all remaining charges will be liable and charged immediately.

Payment confirmation via email to the email address you provide at the point of registration will be issued within 24 hours of successful processing of your payment.You, as the cardholder, must retain a copy of transaction records and Merchant policies and rules.You are responsible for maintaining the confidentiality of your membership account and payment details.

Once a payment card has been replaced by a new one, we will charge the new card only. Should however an account go unpaid for a period of 30 days or more we reserve the right to charge any previous payment card on the account at our sole discretion to obtain funds.

REFUND POLICY
Sanddune Padel Sports Club has a strict NO REFUND policy. Any purchases made will not be refunded. In the event that the booking error has occurred through the absolute fault of Sanddune Padel Sports Club, a refund will in most cases be issued to the same credit card you used for the original purchase. Please allow up to two billing cycles for the credit to appear on your credit card statement.

CONTRACT CANCELATION / FIXED TERM PERIOD
You may cancel your membership whilst still within your contracted minimum number of Monthly Recurring Payments (i.e., Fixed Term Membership of 12 months), under the following circumstances and subject to you providing satisfactory evidence:

Relocation: This agreement can be canceled in the event that your new permanent address is 300km away from any Sanddune Padel Sports Club, either the site you originally signed up for or any other Sanddune Padel Sports Club site. Any cancellation in respect to a member’s relocation is dependent on satisfactory receipt of proof of your relocation and new address (i.e., a new tenancy agreement in your name).
– Long-term (over 3 months) illness or injury: This agreement may be canceled in the event of an illness, injury, or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for 3 months or longer upon appropriate proof being provided. The writing opinion must be dated within 30 days of the request to cancel.
– Pregnancy: This agreement can be freezed if you become pregnant upon the appropriate written proof being given.
– Redundancy/Job Loss: This agreement can be canceled upon providing employer evidence confirming your redundancy with the company stamp. The redundancy must have occurred after your Sanddune Padel Sports Club joining date.

Please note – ANY Cancellation for the above reasons will not be affected until the appropriate proof is provided to a member of Sanddune Padel Sports Club’s team and you receive a written confirmation response from Sanddune Padel Sports Club.

MEMBERSHIP TERMINATION POLICY
All our memberships are subjected to 8 months minimum commitment period. If you have signed up for a membership and you decide you would like to terminate your contract, please note that you will be required to complete the payment of at least 8 months for your cancellation request to be implemented.

Any cancelation request regardless of contract type or situation requires a minimum of 30 days’ notice and all cancelations are subject to satisfactory proof of evidence should you still be within a minimum timeframe commitment before the cancelation of the membership will take effect. You acknowledge and understand that one further recurring payment will be taken from your account if such a recurring payment is due within the aforementioned 30 days’

CANCELLATION POLICY
Court and Coaching Session Cancellations
Padel Coaching Sessions: To maintain quality service and ensure fair scheduling, cancellations for coaching sessions must be made at least 24 hours before the scheduled time. Any cancellation made within 24 hours of the session will be considered a late cancellation, resulting in the session being deducted from your package without rescheduling.

Court Bookings: Cancellations for normal court bookings must also be made at least 24 hours in advance. Cancellations made within 24 hours of the booking will incur a 250 AED cancellation fee. Same-day bookings are considered confirmed and are subject to the same 24-hour cancellation policy.These policies are designed to maintain service excellence, ensuring respect for all clients’ time commitments.


CONTRACT FREEZE
Temporary Illness or Injury:
This agreement may be frozen for a minimum of 1 month and/or a maximum of 3 months in the event of a temporary illness, injury, or medical condition that in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for a period of time.

Out of the country: members can request to freeze a membership up to 1 month when traveling out of the country. Please note this policy does not apply to single sessions or packages.Please note – ANY Freeze will not be affected until the appropriate proof is provided. Once your freeze has been processed you will not have access to the facilities until the freeze period has come to an end.

Please note – A freeze period does not affect the Minimum number of Monthly Recurring

Payments you are due to make and any payments remaining at the time of the freeze will remain due and recommence on a monthly basis once the freeze period has been completed. (Freeze of payment must be submitted 14 working days before the Monthly Recurring Payment is due to be taken, if the submission is too close to the recurring payment date the payment due will not be frozen).

WAIVER AND ACKNOWLEDGEMENT
These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service without the permission of their parent or guardian.

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.Upon termination, your right to use the Service will cease immediately.We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is a material, we will make reasonable efforts to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, you agree to be bound by the revised terms.

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 500 AED if You haven’t purchased anything through the Service. To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data, or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.

TERMINATION
We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.Upon termination, Your right to use the Service will cease immediately.

CHANGES TO OUR TERMS AND CONDITIONS
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
